1. Introduction
The Promotion of Access to Information Act 2 of 2000 gives effect to the right of access to information contained in section 32 of the Constitution of the Republic of South Africa. It applies to records held by both public and private bodies.
Eiffel — Your English Connection is a private body as defined in PAIA, being a natural person who carries on a business or profession otherwise than as an employee. This manual explains what records we hold and how you may request access to them.
We are a very small practice. We hold few records, and most of what we hold relates directly to the person who gave it to us. In practice, most requests can be dealt with informally and at no cost by simply emailing us.

3. The PAIA Guide
The Information Regulator has, in terms of section 10 of PAIA, published a Guide containing information reasonably required by a person wishing to exercise a right under the Act. The Guide is available in each official language, and in Braille, from:

4. Records available without a formal request
The following records are freely available on our website and require no request under PAIA:

No notice has been published in terms of section 52(2) of PAIA listing categories of records automatically available for inspection, purchase, or copying.
5. Categories of records held
We hold the following categories of records. Not every category will contain records at any given time.
5.1 Client and booking records
- Booking confirmations and scheduling records
- Client contact details (name, email address, telephone or messaging handle, time zone)
- Where a lesson is booked for a child: the child’s first name, age or school year, and English level
- Brief teaching notes recording progress and material covered
- Correspondence with clients and parents
5.2 Financial records
- Payment confirmations and transaction records
- Invoices and refund records
- Tax records and returns
5.3 Business and operational records
- Course materials, lesson plans, and teaching resources
- Website content and marketing material
- Policies, including this manual
- Records of safeguarding concerns, where any arise
- Professional qualifications and clearance certificates
6. Records held under other legislation
Records are kept in accordance with, among others:
- Protection of Personal Information Act 4 of 2013
- Income Tax Act 58 of 1962
- Tax Administration Act 28 of 2011
- Electronic Communications and Transactions Act 25 of 2002
- Consumer Protection Act 68 of 2008, where applicable
7. How to request access to a record
- Complete Form 2 of the PAIA Regulations (Request for Access to Record). The form is available from the Information Regulator’s website, or we will email it to you on request at no charge.
- Send the completed form to pieterhcreyneke@gmail.com, or to the postal address in clause 2.
- Provide sufficient detail to enable us to identify the record and to identify you, and state the form of access required.
- State clearly which right you are seeking to exercise or protect, and explain why the record is required for that purpose. PAIA requires this of every requester to a private body, and a request that omits it must be refused.
- If the request is made on behalf of another person, attach proof of your authority to act.
- Indicate whether you wish to be told of the decision in any manner other than in writing, and give the necessary particulars.
We will decide on the request and notify you within 30 days of receipt. That period may be extended by a further 30 days in the circumstances permitted by section 57 of PAIA, in which case we will tell you why.
8. Fees
The fees payable are those prescribed from time to time in the Regulations published under PAIA. In summary:
- A request fee is payable by a requester who is not a personal requester, before the request is processed.
- An access fee may be payable for reproduction, search, preparation, and postage. We will give you a written estimate before proceeding, and you may then confirm or withdraw the request.
- A personal requester — a person requesting a record about themselves — is not required to pay a request fee.
In practice, given how few records we hold, we will usually waive fees entirely for a straightforward request. If you simply want to know what we hold about you or your child, please just email us — that costs nothing and is normally answered within a few days.
9. Grounds on which a request may be refused
Chapter 4 of Part 3 of PAIA sets out the grounds on which access must or may be refused. These include:
- protection of the privacy of a third party who is a natural person (section 63)
- protection of commercial information of a third party or of ourselves (sections 64 and 68)
- protection of confidential information of a third party (section 65)
- protection of the safety of individuals and of property (section 66)
- records privileged from production in legal proceedings (section 67)
- protection of research information (section 69)
- where the request is manifestly frivolous or vexatious, or the work involved would substantially and unreasonably divert our resources (section 45)
Access may nevertheless be granted where section 70 applies — that is, where disclosure would reveal a substantial contravention of the law or an imminent and serious public safety or environmental risk, and the public interest in disclosure clearly outweighs the harm.
A note on records about children. Records relating to a child will ordinarily be released only to that child’s parent or guardian, and we may refuse or limit disclosure where release would not be in the child’s best interests.
10. Your remedies if a request is refused
There is no internal appeal against a decision of a private body. If your request is refused, or you are unhappy with how it was handled, you may:
- ask us to reconsider — we would prefer to resolve the matter directly;
- lodge a complaint with the Information Regulator in terms of section 77A of PAIA, using Form 5 of the Regulations, within 180 days; or
- apply to a court with jurisdiction in terms of section 78 of PAIA.
11. Requests under POPIA
Separately from PAIA, you have rights under the Protection of Personal Information Act to object to our processing of your personal information, and to ask for it to be corrected or deleted. These are dealt with in our Privacy Policy, and may be exercised simply by emailing us. The prescribed forms are Form 1 (objection to processing) and Form 2 (correction or deletion) of the POPIA Regulations.
12. Availability and updating of this manual
This manual is published on our website at eiffelyourenglishconnection.com/paia-manual and is available free of charge by email on request. A copy is available for inspection at our address during ordinary business hours, by prior arrangement.
The manual is reviewed at least annually and updated whenever our records or processes change materially.
